BlockCheck uses this notice to clearly and unambiguously notify candidates/ applicants/ ‘data subjects’ (those being checked for employment and/or compliance purposes) about the personal data that the BlockCheck holds relating to them, how they can expect their personal data to be used, held and disposed of; as well as the purpose for which the data is held or used.
BlockCheck is committed to protecting the privacy and security of your personal information at all times. Protection of personal information is also a key consideration within the design of our systems and in the way BlockCheck uses technology to enhance the process. This privacy notice describes how we collect and use personal information about you during the course of your relationship with us, in accordance with the General Data Protection Regulation (GDPR). BlockCheck is a “data processor”. This means that we are responsible for processing personal data provided by you in order to conduct a specific scope of checks required by a prospective employer. We are required under data protection legislation to notify you of the information contained in this privacy notice. This notice does not form part of any contract of employment or other contract to provide services. We may update this notice at any time as required. It is important that you read this notice, together with any other privacy notice we may provide on specific occasions when we are collecting or processing personal information about you, so that you are aware of how and why we are using such information.
We will comply with data protection law. This states that the personal information we hold about you must be:
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We will collect, store, and use the following categories of personal information about you: first name, middle names, surname, former names, date of birth, NI number or country-specific similar ID, nationality, place of birth, address history, telephone number, email address, employment history, education history, education certificates, passport photo page or other relevant ID document / visa, proof of current address, other supporting documents as relevant to complete the process (JSA documents etc.) We may also collect, store, handle and use the following “special categories” of more sensitive personal information: information about criminal convictions and offences that are eligible based on the requirements and scope of the process. Information about court judgments and insolvency notices that are required by the scope of the process.
The personal information that enables BlockCheck to contact you in order to initiate the process (name, email address and telephone number) is provided to us directly by the prospective employer/ recruiter. In some cases, as required by the process, the prospective employer may also provide us with a copy of your CV and other relevant documents that is required legitimately by the business. All other personal information and supporting documentation is provided by you during the application process. Within the checking process we also collect, receive and process personal information either directly from you or from authorised and recognised criminal and credit reference agencies. (These will include: DBS, Call Credit, LexisNexis and Cifas) We will also collect verification information from your former employers, recruitment agencies, named referees and places of education. This is for the purposes of completing the required checks and by your consent.
We will only use your personal information when the law allows us to do so and only for the purposes of conducting the checks required to satisfy the hiring process of your prospective employer.
We need all the categories of information listed above primarily to allow us to perform required checks and to enable us to comply with the requirements of your prospective employer’s hiring and compliance obligations. We do not use this information for any other purpose.
We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
We may have to share your data with third parties, including third-party service providers and other entities to complete the process. We require third parties to respect the security of your data and to treat it in accordance with the law. We may transfer your personal information outside the EU only if specifically required to conduct a check within that country. Some third parties to whom we may transfer your personal data may be located outside of the UK or the EEA. In the event of a transfer, we will seek to ensure that appropriate safeguards to protect your data are in place which could include entering into a data transfer agreement with such third parties to ensure adequate protection for your information. If we do, you can expect a similar degree of protection in respect of your personal information.
All our third-party service providers and other entities in the group are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.
We will share your personal information with other entities in our group as part of our regular administrative and invoicing activities. In these cases we will only share your name and no other personal data.
We have put in place measures to protect the security of your information. Details of these measures are available upon request. Third parties will only process your personal information on our instructions and where they have agreed to treat the information confidentially and to keep it secure. We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to only the parties who have a legitimate business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.
We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Details of retention periods for different aspects of your personal information are available in our retention policy which is available from the Managing Director of BlockCheck. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you. Once you are no longer part of the checking process we will securely and permanently destroy your personal information (both hard and electronic versions) in accordance with our data retention policy and applicable laws and regulations.
It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your relationship with us.

We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that personal information is not disclosed to any person who has no right to receive it.
In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information fora specific purpose, you have the right to withdraw your consent for that specific processing at any time. To withdraw your consent, please contact the Managing Director of BlockCheck. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law.
We have appointed a data protection officer (DPO)/ data privacy manager to oversee compliance with this privacy notice. If you have any questions about this privacy notice or how we handle your personal information, please contact the DPO or the Managing Director of BlockCheck. You have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues.

BlockCheck at PeopleCheck will conduct screening and compliance checks that are required in relation to your employment or contract. These checks will include the following:
Your personal information will be used to verify your identity. Your identity documents will be assessed to ensure that you have the legal right to work (RTW) within the relevant jurisdiction.
Checks will include address verification, financial checks relating to insolvency and court judgment information within your current country of residence and overseas if relevant within the scope of the checks required by your prospective employer. The data sources searched will relate to consumer data collated by CallCredit. This does not include credit history information, does not leave a footprint on your credit score and the findings will not be retained or used for any other purpose other than completion of these checks.
Searches databases of global sanctions and PEP (politically exposed persons) listings collated by LexisNexis Risk Services to assess sanction or PEP listings. Financial regulatory registers, directorship records and industry bodies may also be checked as relevant within the hiring process of the prospective employer. (E.g. FCA, ACCA, Companies House).
Checks with LexisNexis press databases and open source public internet data.
Contacting former employers in order to confirm the details of your employment. During this process the following may be required/ requested to be confirmed: positions and role(s) held dates of employment and any other information that may be required or relevant as part of the hiring process for your prospective employer.
Contacting your former educational establishments, and/or the relevant educational clearing house, as required or relevant as part of the hiring process for your prospective employer. This will be to confirm attendance and award of relevant qualifications.
A criminal record check for unspent convictions will be conducted. I provide my consent for PeopleCheck/ BlockCheck to process and handle my information for the purposes of completing this check. I consent to the DBS providing an electronic result directly to the responsible organisation that has submitted my application. I understand that an electronic result contains a message that indicates either the certificate does not contain criminal record information or to await certificate which will indicate that my certificate contains criminal record information. I also consent to PeopleCheck receiving and inspecting my basic disclosure certificate and for the certificate to be received at the PeopleCheck address. In the course of processing the check the Disclosure and Barring Service (DBS) will refer the details provided on this application form to government and law enforcement bodies in accordance with any relevant legislation. The details provided to these bodies will be used for identifying possible matches to records held by them. Where such a match is established, data may be released to the DBS for inclusion on any certificate issued. The details provided on this form may be used to update the records held by the bodies specified above. The details provided on the application form may be used to verify my identity for authentication purposes. The DBS may use any information provided by the DBS on a certificate or otherwise held by the DBS to inform any of its barring decisions made under its powers within the Safeguarding Vulnerable Groups Act 2006. I have read the Basic DBS Check Processing Privacy Policy https://www.gov.uk/government/publications/dbs-privacy-policies and I understand how DBS will process my personal data. I have provided complete and true information in support of the application and I understand that knowingly making a false statement for this purpose is a criminal offence.
